Brendania was founded on October 21, 2026, by three instruments adopted the same day: the Declaration of Independence, the Imperial Constitution, and the Imperial Act of Ratification. Together they name the state, identify Bir Tawil as its territory, vest the Crown in Brendan Smith I, establish the House of Smith as the hereditary dynasty, and set out the offices of state.
The Empire describes its foundation as an act of founding, not secession. It does not claim authority derived from Egyptian or Sudanese law and is distinct from both neighbouring republics.

The Crown
The Crown is the central institution of the Brendanian state. The Emperor is Head of State and Head of Government and holds executive and legislative authority under the Imperial Constitution. The person of the Emperor and the institution of the Crown are distinct: the monarch occupies the office, and the office provides continuity beyond the monarch.
Succession is hereditary within the House of Smith. The reigning Emperor may designate an heir by written decree, and a regency may be constituted if the sovereign cannot exercise the office.
Government and institutions
The Imperial Constitution provides for ministers of state, an Imperial Judiciary, an Imperial Treasury, and a consultative Imperial Assembly. Each is constituted by Imperial Decree as the Empire grows.
Bir Tawil, the territory of the Empire
Bir Tawil was the one sizeable land territory outside Antarctica claimed by no state: true no man's land. By the Declaration of Independence of October 21, 2026, the Emperor claimed it as the sovereign territory of Brendania.
The Empire honours the ties of the Ababda and Bishari communities to the region and will take them into account in every development of the territory.
