What terra nullius means
Terra nullius is Latin for "nobody's land". In classical international law it described territory not under the sovereignty of any state, which a state could therefore acquire by effective occupation.
The concept has a troubled history. European powers used it to treat inhabited lands as legally empty, disregarding the peoples who lived there. Modern international law has rejected that use.
Why Bir Tawil was terra nullius
Bir Tawil was the only sizeable land territory outside Antarctica that no state claimed. Egypt places it in Sudan; Sudan places it in Egypt. Neither administers it. In the plain sense of land belonging to no country, it was no man's land.
The debate
Some lawyers argue that Bir Tawil is better understood as a territory subject to an unresolved boundary dispute between two states than as true terra nullius. On this view, a settlement of the Egypt–Sudan border would place Bir Tawil in one state or the other, and the territory is not open to acquisition by third parties in the meantime.
There is also the question of people. In its 1975 Western Sahara advisory opinion, the International Court of Justice found that territory inhabited by tribes or peoples having a social and political organization was not terra nullius. The Ababda and Bishari have long used the wider area. The Empire of Brendania recognizes their ties to the land.
Bir Tawil and Marie Byrd Land
Marie Byrd Land in Antarctica is much larger and also unclaimed by any state, but it is governed by the Antarctic Treaty System, which freezes new territorial claims. Bir Tawil is under no such treaty, which is why it attracts individual claimants.
Where Brendania's claim fits
The Sovereign Empire of Brendania claimed Bir Tawil, then terra nullius, under its Declaration of Independence of October 21, 2026. The Empire does not treat the land as empty of people. Its founding narrative describes the desert as a landscape with human history and commits the Empire to respecting existing interests, seeking consent, and engaging Egypt and Sudan peacefully.
